Introduction

Tailored Tidings LLC, a Tennessee limited liability company ("us", "we", or "our"), operates a hyper-personalized daily news digest newsletter (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you subscribe to or use the Service. We are committed to safeguarding your privacy and complying with applicable laws, including the Tennessee Information Protection Act (TIPA), effective July 1, 2025, the CAN-SPAM Act, and other relevant regulations.

By using the Service, you consent to the practices described in this Privacy Policy, including the sharing of your preferences and interests with third-party AI APIs for newsletter curation. If you do not agree, please do not use the Service. This policy is provided for informational purposes and does not constitute legal advice. We recommend consulting a Tennessee-licensed attorney to ensure compliance with your specific needs.

1. Information We Collect

We collect the following types of information:

Personal Information

When you subscribe, we collect your email address and any preferences you provide (e.g., interests in business, technology, lifestyle, entertainment) to personalize your news digest. If you participate in a future referral program, we may collect additional details like your name or referral codes.

Sensitive Personal Information

Depending on your preferences, we may collect or infer sensitive data (e.g., political opinions, religious beliefs, or health-related interests if selected for news topics). We process sensitive data only with your explicit opt-in consent, as required by TIPA.

Payment Information

For paid subscriptions, we collect billing information (e.g., credit card details) through our payment processor, Stripe. We do not store payment details directly; Stripe securely processes and stores this information.

Usage Data

We may collect non-identifying information about your interaction with the Service, such as open rates, click-through rates, or device information (e.g., IP address, browser type, operating system) to improve personalization and Service performance.

Direct Mail Information

If you engage with our direct mail campaigns (e.g., via USPS Every Door Direct Mail), we may collect data from opt-in responses or QR code interactions, such as your email or preferences.

Age Verification

For users under 18, we may collect parental consent information to comply with the Children's Online Privacy Protection Act (COPPA).

2. How We Collect Information

We collect information through the following methods:

  • Directly from You: When you subscribe, update preferences, or interact with our website or emails (e.g., via forms or surveys).
  • Automatically: Through cookies, web beacons, or analytics tools (e.g., Google Analytics) to track usage patterns and optimize the Service.
  • Third Parties: From Stripe for payment processing or from public sources for news curation. If a referral program is launched, we may collect data from referred subscribers.

3. How We Use Your Information

We use your information to:

  • Deliver and personalize daily news digests based on your preferences, using algorithms and AI tools, including third-party AI APIs.
  • Process payments and manage subscriptions via Stripe.
  • Send promotional emails, updates, or marketing materials (with opt-out options).
  • Improve the Service through analytics (e.g., tracking open rates to refine content).
  • Administer referral programs (if implemented) to track and reward referrals.
  • Respond to your inquiries or support requests.
  • Comply with legal obligations, such as TIPA, CAN-SPAM, and COPPA.
  • Conduct data protection assessments for high-risk activities, such as AI-driven personalization, as required by TIPA.

We may share your preferences and interests with third-party AI APIs to enhance curation and personalization. This involves automated decision-making, which may impact the content you receive. We adhere to data minimization principles, sharing only the necessary data for these purposes. AI outputs may have errors or biases; see Section 9 for details.

4. How We Share Your Information

We do not sell your personal information. We may share information as follows:

  • Service Providers: With trusted third parties like Stripe for payment processing, analytics providers for usage insights, or third-party AI APIs (e.g., AI models from providers like OpenAI or Google) for content curation and personalization based on your preferences and interests. These shares are governed by strict data protection agreements compliant with TIPA, limiting use to Service purposes, ensuring data minimization, security, and prohibiting further sharing without consent.
  • Legal Compliance: To comply with legal obligations, such as responding to subpoenas or enforcing our Terms and Conditions.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred with notice and consent where required.
  • Referral Program: If launched, we may share limited data (e.g., email, referral code) to verify referred subscribers and award free months.

For international transfers (e.g., to AI providers outside the U.S.), we use mechanisms like Standard Contractual Clauses to ensure adequate protection under GDPR or similar laws, where applicable.

5. Your Rights Under TIPA and Other Laws

As a Tennessee-based company, we comply with TIPA, effective July 1, 2025. You may have the following rights, subject to verification:

  • Access: Request a copy of your personal information we hold.
  • Correction: Request correction of inaccurate information.
  • Deletion: Request deletion of your personal information, subject to legal retention requirements.
  • Opt-Out: Opt out of the sale of personal information or targeted advertising (we do not currently sell data or use targeted ads, but you can opt out of future practices). You may also opt out of sharing your preferences with third-party AI APIs by updating your account settings or contacting us, though this may limit personalization features.
  • Non-Discrimination: We will not discriminate against you for exercising these rights.

To exercise these rights, contact us at hello@tailoredtidings.com. We will respond within 45 days, as required by TIPA, and may extend this period if needed, with notice. For users outside Tennessee, similar rights may apply under laws like GDPR or CCPA, where applicable.

6. Your Choices

You have control over your information:

  • Opt-Out of Marketing: Unsubscribe from promotional emails using the link in any email or by contacting hello@tailoredtidings.com.
  • Preferences: Update or delete your personalization preferences via your account.
  • Do Not Track Signals: We do not respond to browser Do Not Track (DNT) signals, as there is no standard for compliance. Use opt-out options above instead.
  • Cookies: Manage cookies via your browser settings; however, disabling them may affect Service functionality.
  • Third-Party Sharing: Opt out of sharing preferences with third-party AI APIs via your account settings, which may reduce personalization accuracy.
  • Sensitive Data Consent: You can withdraw consent for processing sensitive data at any time, though this may limit relevant content delivery.

7. Data Security

We use industry-standard security measures (e.g., encryption, secure servers) to protect your information. When sharing data with third-party AI APIs, we ensure anonymization where possible and require them to implement equivalent security standards. However, no system is completely secure, and we cannot guarantee absolute protection against unauthorized access or breaches. You are responsible for maintaining the confidentiality of your account credentials.

8. Data Retention

We retain your personal information only as long as necessary to provide the Service, comply with legal obligations, or resolve disputes. For example:

  • Email and preference data are retained while your subscription is active.
  • Payment data is managed by Stripe and retained per their policies.
  • Usage data may be retained for up to 2 years for analytics purposes.

Upon cancellation or opt-out of data sharing, we delete or anonymize your personal information within 30 days, except as required by law (e.g., tax records).

9. AI Use and Transparency

We use AI technologies, including third-party AI APIs, to curate and personalize content. AI tools analyze your preferences and interests to generate tailored news digests. You acknowledge that:

  • AI outputs may contain errors, biases, or inaccuracies from training data, source content, or shared preferences.
  • Automated decision-making may affect the content delivered to you.
  • We disclaim liability for inaccuracies in AI-generated content.

We strive to use AI ethically, regularly reviewing algorithms for fairness and ensuring third-party providers comply with data protection standards. Contact us at hello@tailoredtidings.com for questions about AI use or to opt out of third-party AI sharing.

10. Cookies and Tracking

We use cookies and similar technologies (e.g., web beacons) to enhance your experience, track usage, and personalize content. You can manage cookie preferences via your browser settings. Our website may use third-party analytics tools (e.g., Google Analytics) to collect non-identifying data. See our Cookie Policy on our website for details.

11. Children's Privacy

The Service is not intended for users under 18 without parental consent, per COPPA. We do not knowingly collect data from children under 13 without verified parental consent. If we learn we have collected such data, we will delete it promptly. Contact us at hello@tailoredtidings.com to provide or verify parental consent.

12. Data Breach Notification

In the event of a data breach affecting your personal information, we will notify you and relevant authorities as required by TIPA (within 45 days if over 1,000 Tennessee residents are impacted) or other applicable laws. Notifications will be sent via email to your registered address.

13. Direct Mail Campaigns

If you engage with our direct mail promotions (e.g., via USPS Every Door Direct Mail), we may collect data from opt-in responses or QR codes. We comply with the Deceptive Mail Prevention and Enforcement Act and provide opt-out instructions. To opt out of direct mail, contact hello@tailoredtidings.com.

14. International Users

The Service is operated from the United States and governed by U.S. and Tennessee law. If you access the Service from outside the U.S., your data may be transferred to and processed in the U.S., where privacy laws may differ. By using the Service, you consent to this transfer. For EU/UK users, we comply with GDPR where applicable, including GDPR for international data transfers to third-party AI APIs.

15. Third-Party Services

We use Stripe for payment processing. Stripe's Privacy Policy governs their handling of your payment data. For AI curation, we may share preferences with third-party AI APIs (e.g., models from providers like OpenAI or Google), subject to data protection agreements ensuring confidentiality and limited use. Links to third-party websites or content in our digests are not controlled by us, and we are not responsible for their privacy practices.

16. Changes to This Privacy Policy

We may update this Privacy Policy at any time. Material changes will be notified at least 30 days in advance via email to subscribers. Continued use of the Service after changes constitutes acceptance. If you do not agree, you must discontinue use.

17. Contact Us

For questions, to exercise your rights, or to report concerns, contact Tailored Tidings LLC at hello@tailoredtidings.com. Legal notices may also be sent to our registered agent's address on file with the Tennessee Secretary of State.

This Privacy Policy is effective as of 8/25/2025 and will remain in effect except with respect to any changes in its provisions in the future.
